The Analytical Department is an important part of the Court of Justice of the European Union. It is the analysts who are the first to receive a reference for a preliminary ruling or any other reference and who draw up the so-called preparatory report. As indicated by Judge Miroslav Gavalec, the analytical department makes a preliminary assessment of each case, searches for the relevant preliminary rulings and proposes options or alternatives for resolving the issues under consideration.<\/strong> “The judge of the CJEU will receive from the analytical department of the court the basis for the greater part of the later judgment,”<\/strong> Judge Miroslav Gavalec added.<\/strong><\/p>\n

Once the department unit has drawn up its report, the case is assigned to the rapporteur judge. On the basis of a further analysis of the case, the Judge, in cooperation with their assistants, draws up a report for the full CJEU and proposes the designation of a panel to hear and decide the case.<\/p>\n

In that connection, Judge Miroslav Gavalec said that there were several possibilities as to which panel the case would be assigned to. “Simple cases are decided by a three-member Panel, a five-member Panel deals with new case-law and the most difficult cases, where there is a change in case-law, are decided by a Grand panel with fifteen members and headed by the President of the CJEU,” Judge Miroslav Gavalec explained to the judges and assistants of the Supreme Administrative Court who were in attendance.<\/p>\n

At the end of his lecture, he described how the hearings are ordered and how they are conducted – interestingly, the parties are allocated 15 minutes to defend themselves (in some cases it is possible to extend the defence time). He added that the draft judgment is decided at the final hearing. After the conclusion of his lecture, the second part of the programme, namely the discussion, began.<\/p>\n

“It is extremely interesting to hear how much emphasis the CJEU places on the consistency of its own case law in its rulings. In this respect, the presentation by our colleague Miroslav Gavalec was a great inspiration for us,” said Mari\u00e1n Tren\u010dan, Vice-President of the Supreme Administrative Court.<\/p>\n

JUDr. Ing. Miroslav Gavalec, PhD. started as a judge in 2001 at the District Court Bratislava III. Since 2005 he has been working at the Supreme Court of the Slovak Republic, first as a judge of the Administrative Chambre and since 2009 as the President of the Panel of the Administrative Chamber. In parallel with his judicial career, he has also devoted himself to teaching. From 2005 to 2011 he taught at the Institute of Economics and Management of the Pan-European University in Bratislava. From 2005 to 2020 he was a member of the European Union Forum of Judges for the Environment. On 7 October 2021, he was appointed a CJEU of the EU by the representatives of the governments of the Member States.<\/p>\n","protected":false},"excerpt":{"rendered":"
