{"id":47808,"date":"2023-06-22T14:50:05","date_gmt":"2023-06-22T12:50:05","guid":{"rendered":"https:\/\/www.nssud.sk\/?p=47808"},"modified":"2026-04-01T12:50:36","modified_gmt":"2026-04-01T10:50:36","slug":"meeting-of-the-slovak-polish-and-czech-supreme-administrative-court","status":"publish","type":"post","link":"https:\/\/www.nssud.sk\/en\/meeting-of-the-slovak-polish-and-czech-supreme-administrative-court\/","title":{"rendered":"Meeting of the Slovak, Polish and Czech Supreme Administrative Court"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>For the first time in the history of the meeting, which has been organised by the Czech and Polish Supreme Administrative Courts since 2011, representatives from Slovakia were invited to the ceremony. The bilateral event is held annually with the aim of providing a regular dialogue between the judges of the highest administrative courts and the exchange of current knowledge or challenges in the decision-making activity of the (supreme) administrative courts.<\/strong><\/p>\n<p style=\"text-align: justify;\">As part of the foreign meeting, the President of the Court, Pavol Na\u010f, received from the President of the Supreme Administrative Court of the Republic of Poland, Jacek Chlebny, and the President of the Voivodship Administrative Court in Krak\u00f3w, Anna Dumas, the commemorative medal of the Voivodship Administrative Court in Krak\u00f3w.<\/p>\n<p style=\"text-align: justify;\">The working part of the meeting consisted of four Panels. In the first one, the judges dealt with the current issues of the Common European Asylum System (CEAS) and the related case-law of the Court of Justice of the European Union. During the debate, the Panellists also addressed the new phenomenon of hybrid warfare, the so-called &#8220;push-back cases&#8221; on the Belarusian-Polish border. The Polish legislator&#8217;s response to this phenomenon is two amendments to the Aliens Act, which currently allow the Republic of Poland, in relation to refugees brought to the Belarusian-Polish border, to leave an application for international protection pending or to order an immediately enforceable departure from the territory.<\/p>\n<p style=\"text-align: justify;\">Another session focused on the problem of double taxation. In this part, Barbara Po\u0159\u00edzkov\u00e1, Vice-President of the Supreme Administrative Court of the Czech Republic, made a presentation, among others, on the case-law on double taxation treaties, mentioning the <em>&#8220;Multilateral Instrument&#8221;<\/em>, which, based on the Model Treaty of the Organization for Security and Cooperation in Europe, prevents double taxation as from 2018.<\/p>\n<p style=\"text-align: justify;\">The other two Panels dealt with the legal aspects of strategic construction projects, including the permitting process for the construction of a nuclear power plant and various associated aspects of building this type of infrastructure. The participants also discussed the recent case-law of the CJEU on VAT in the practice of Czech administrative courts, with an emphasis on proving the person of the supplier and the conditions of tax exemption for intra-community supplies.<\/p>\n<p style=\"text-align: justify;\">The bilateral meeting in Krakow, Poland, was also attended by International Relations and Protocol Specialist Alica Smol\u00ed\u010dkov\u00e1 from the Chancellery\u00a0of the Supreme Administrative Court of the Slovak Republic.<\/p>\n","protected":false},"excerpt":{"rendered":"<div style=\"text-align: justify;\">Vedenie Najvy\u0161\u0161ieho spr\u00e1vneho s\u00fadu Slovenskej republiky sa z\u00fa\u010dastnilo na stretnut\u00ed po\u013esk\u00fdch a\u00a0\u010desk\u00fdch sudcov spr\u00e1vnych s\u00fadov.
