{"id":47895,"date":"2024-03-12T08:13:27","date_gmt":"2024-03-12T07:13:27","guid":{"rendered":"https:\/\/www.nssud.sk\/?p=47895"},"modified":"2026-04-01T11:53:00","modified_gmt":"2026-04-01T09:53:00","slug":"judge-michal-matulnik-attended-the-aca-europe-seminar","status":"publish","type":"post","link":"https:\/\/www.nssud.sk\/en\/judge-michal-matulnik-attended-the-aca-europe-seminar\/","title":{"rendered":"Judge Michal Matuln\u00edk attended the ACA-Europe seminar"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>The case-law of the courts, in particular of the supreme courts, now constitutes an important source of law which brings clarity to the process of interpretation of legal norms.\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\"><img loading=\"lazy\" class=\"aligncenter wp-image-2385 size-full\" src=\"https:\/\/www.nssud.sk\/wp-content\/uploads\/group-ft.jpg\" alt=\"Group photo of the participants in the ACA-Europe seminar.\" width=\"1920\" height=\"1011\" \/><\/p>\n<p style=\"text-align: justify;\">Therefore, the core theme of the expert seminar organised by ACA-Europe was mechanisms to avoid conflicting decisions of national courts, the Court of Justice of the European Union and the European Court of Human Rights. The Supreme Administrative Court of the Slovak Republic was represented at the seminar in Zagreb on the 19th of February 2024 by Judge Michal Matuln\u00edk.<\/p>\n<p style=\"text-align: justify;\">The conclusions of the seminar are summarised in the ACA-Europe report, which, among other things, points out that the courts&#8217; decision-making clarifies how statutory provisions should be interpreted and applied. The case-law of the courts, by its very nature, upholds the rule of law and the rule of law, and it is therefore also essential to ensure that it is uniform and predictable. At the same time, uniformity of case-law also enables the parties to the proceedings to anticipate the interpretation of a particular provision in practice, which may ultimately help them to set their expectations correctly in relation to the outcome of the judicial proceedings.<\/p>\n<p style=\"text-align: justify;\">The document also contains an interesting mention of social trends that judges reflect in their case law. In such a case, the case law is also of indisputable value to the legislator, as it draws the legislator&#8217;s attention to areas that need to be legislatively adjusted or modified.<\/p>\n<p style=\"text-align: justify;\">The ACA-Europe report was prepared on the basis of an expert questionnaire in which 28 European countries, including the Slovak Republic, participated.
