Participants discussed issues of independence and impartiality of judges, individual rights such as the right to freedom of speech and the right to express one’s opinion. Although respondents from each country stressed that there are generally no individual rules that would restrict judges’ freedom of expression and opinion more broadly, they pointed to the need to maintain responsible conduct, even after a judge has retired. Judges must avoid situations that could jeopardise public confidence in the fairness of the judicial system, as well as damage the reputation and dignity of their office, profession and judicial authority.

The selection of new judges for the various supreme administrative courts, the process and the specifics of this selection were the main topics of the third block of discussions. The judges discussed not only the qualifications of individual candidates and their personal qualities, but also the specifics and requirements of the selection process in each country. In this area, the round table also addressed the issue of the intervention of the executive branch in the process of recruitment and appointment of judges, as well as the issue of the possibility of challenging the appointment of judges.

The ACA-Europe seminar was held on 29 November 2024 in Versailles, France.

The Association of Councils of State and Supreme Administrative Jurisdictions of the European Union (ACA-Europe), in cooperation with the Council of State of France, organised a seminar on “Ethics and the recruitment of members of the Supreme Administrative Courts and Councils of State”, which took place in Versailles.
