On 3 March 2025, the Supreme Administrative Court submitted its comments and objections to the draft law amending and supplementing the basic legal regulations governing the status of judges, the functioning of courts and the Judicial Council of the Slovak Republic, as well as the proceedings before the Supreme Administrative Court in disciplinary cases. Many of the comments made are of a fundamental nature<\/p>\n
Particularly in relation to the draft amendment to Act No 432\/2021 Coll. (Disciplinary Procedure Code in the current wording), the impossibility of practical implementation of the proposed wording of the Act was highlighted, resulting in particular from the composition of the disciplinary chambers, in which the Supreme Administrative Court is to be represented by only one person, both in the first instance and in the appeal disciplinary proceedings. Moreover, this composition of the disciplinary chambers creates a significant constitutional tension between the proposed amendment and the wording of Article 142(2)(c) of the Constitution of the Slovak Republic. There is no objective reason to fundamentally change the current legal situation in this respect.<\/p>\n
The current legal regulation of disciplinary proceedings at the Supreme Administrative Court has been applied by the disciplinary chambers in a proper quality and speed of proceedings, which is also evident from the available statistical data.<\/p>\n
The management of the Supreme Administrative Court expresses its conviction that its views on the proposed legislative changes will be taken into account both in the consultation procedure and in the further stages of the legislative process.<\/p>\n","protected":false},"excerpt":{"rendered":"
