The defendant (the successful candidate in the election) filed an action against the court&#8217;s decision declaring the election null and void with the Constitutional Court of the Slovak Republic, by which he sought a declaration that his rights had been violated by the judgment of the Supreme Administrative Court. The Constitutional Court upheld the action, quashed the judgment of the Electoral panel and returned the case to it for further proceedings (Case No. 13 Svp 3\/2023).<\/strong><\/p>\n<p style=\"text-align: justify;\">In the new proceedings, the Electoral panel, bound by the legal opinion of the Constitutional Court (ruling No. II \u00daS 169\/2023-37), supplemented the evidence by examining a witness and, after its evaluation, decided to reject the election claim.<\/p>\n<p style=\"text-align: justify;\">The decision was adopted unanimously and is final. The written reasons for the decision will be published within the statutory period.<\/p>\n<p style=\"text-align: justify;\">In the electoral action, Ing. Franti\u0161ek Mojcher c\/a Bc. Maro\u0161 Ko\u010di\u0161 was decided by the Panel No. 13 of the Supreme Administrative Court, composed of: the President of the Panel JUDr. Viola Tak\u00e1\u010dov\u00e1, PhD. (Judge-rapporteur) and the members of the Panel JUDr. Katar\u00edna Benczov\u00e1, JUDr. Jana Martin\u010dekov\u00e1, JUDr. Michal Matuln\u00edk, PhD., Mgr.
