{"id":59095,"date":"2025-07-28T10:36:24","date_gmt":"2025-07-28T08:36:24","guid":{"rendered":"https:\/\/www.nssud.sk\/?p=59095"},"modified":"2026-04-29T12:40:08","modified_gmt":"2026-04-29T10:40:08","slug":"the-supreme-administrative-court-of-the-slovak-republic-rejects-a-police-officers-complaint-regarding-the-review-of-his-dismissal-from-service","status":"publish","type":"post","link":"https:\/\/www.nssud.sk\/en\/the-supreme-administrative-court-of-the-slovak-republic-rejects-a-police-officers-complaint-regarding-the-review-of-his-dismissal-from-service\/","title":{"rendered":"The Supreme Administrative Court of the Slovak Republic rejects a police officer&#8217;s complaint regarding the review of his dismissal from service"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>On May 29, 2025, the Supreme Administrative Court, by judgment Case No. 6Ssk\/123\/2024, dismissed the cassation complaint of a former police officer against the dismissing judgment of the Administrative Court in Bratislava in the matter of reviewing the legality of the personnel order of the Minister of the Interior of the Slovak Republic, by which the man was dismissed from service as a member of the Police Force. The reason was the violation of the oath and obligations to perform duties, comply with the law and refrain from actions that could undermine the dignity of the Police Force or threaten trust in it.<\/strong><\/p>\n<p style=\"text-align: justify;\">The Court of Cassation examined whether the arrogant and undignified behavior of a police officer while being subjected to an alcohol test after stopping a motor vehicle could constitute a violation of the oath of office or duty in a particularly serious manner, with the understanding that retaining the police officer in service would be detrimental to the important interests of the civil service.<\/p>\n<p style=\"text-align: justify;\">The proceedings proved that the police officer in question was checked by a police patrol during off-duty hours at night, and he told them that he had previously consumed alcohol, then parked the motor vehicle (driven it) and refused to take a breathalyzer test, claiming that he was not the driver. He did not obey several appeals from the police patrol and tried to escape. The police patrol was therefore forced to use coercive measures &#8211; grabs, gropes and handcuffs the man. During the check, he behaved arrogantly and undignifiedly.<\/p>\n<p style=\"text-align: justify;\">The Court of Cassation agreed with the opinion of the public administration authorities and the administrative court that the proven behavior of the police officer concerned during the police check constitutes a reason for his dismissal from service. A police officer is obliged to keep his oath, perform his duties and comply with the law, and refrain from actions that could undermine the dignity of the police force or endanger trust in this force (both in the performance of civil service and outside it).
