The cassation court stated that when a municipality determines street names through a generally binding regulation, the effects of previous street naming decisions cease, and the new names must comply with the law.<\/strong><\/p>\n<p style=\"text-align: justify;\">On May 26, 2011, the municipality of Var\u00edn adopted a generally binding regulation on the designation and renaming of streets and other public spaces within the municipality. This regulation included the designation of a street as \u201cDr. Jozef Tiso Street,\u201d a name originally assigned by a municipal resolution in 1993. Following a petition by residents of Var\u00edn, the General Prosecutor\u2019s Office of the Slovak Republic challenged the legality of this regulation. Specifically, it argued that the name referred to a historically significant but negatively perceived deceased figure, that it was offensive to morality, religious or national sentiment, and that it was linguistically incorrect. The Administrative Court in Bansk\u00e1 Bystrica upheld the General Prosecutor\u2019s Office administrative action.<\/p>\n<p style=\"text-align: justify;\">The Supreme Administrative Court addressed the issue within the scope of the municipality of Var\u00edn\u2019s objection that the legal basis for naming the street \u201cDr. Jozef Tiso\u201d was not the generally binding regulation from 2011, but rather a municipal resolution from 1993. According to the municipality, this meant that the General Prosecutor\u2019s lawsuit was filed too late.<\/p>\n<p style=\"text-align: justify;\">The Cassation Court did not agree with the argument presented by the municipality of Var\u00edn. According to the Act on Municipal Establishment, as amended effective from January 1, 2002, the municipality determined both the rules for naming streets and the list of street names\u2014including \u201cDr. Jozef Tiso Street\u201d\u2014through a generally binding legal regulation. By doing so, the municipality either established or partially changed the names of streets regardless of whether they had previously been named by an earlier resolution. With the entry into force of the generally binding regulation, the legal effects of previous naming decisions ceased. The General Prosecutor\u2019s Office therefore correctly challenged the compliance of the municipality\u2019s regulation with the Act on Municipal Establishment\u2014specifically in the part concerning the naming of \u201cDr. Jozef Tiso Street\u201d\u2014first through a protest and later through an administrative lawsuit.<\/p>\n<p style=\"text-align: justify;\">The Cassation Court could not address the legal question of whether the designation of \u201cDr. Jozef Tiso Street\u201d was in compliance with the Act on Municipal Establishment, because the municipality of Var\u00edn did not challenge this part of the administrative court\u2019s assessment in its cassation complaint.<\/p>\n<p style=\"text-align: justify;\">This decision was adopted unanimously by the panel of the Supreme Administrative Court. No legal remedy is admissible against it.<\/p>\n<p style=\"text-align: justify;\">The decision was made by Panel No. 8 of the Supreme Administrative Court, composed of: President of the Panel Mgr.
