The Supreme Administrative Court of the Slovak Republic, in cooperation with the Supreme Court of the Slovak Republic, organized an educational event on October 13, 2025 on the topic of \u201cBankruptcy and Restructuring in Civil Litigation and Administrative Proceedings\u201d.<\/strong><\/p>\n

The event was opened by the Vice-President of the Supreme Administrative Court, Mari\u00e1n Tren\u010dan. \u201cWe organized the first joint symposium of the supreme courts two years ago. By preparing such meetings, we want to create a platform not only for judges of the highest court instances, but also for judges of lower courts and interested experts from the private and public sectors to discuss cross-cutting topics in which both the Supreme Court and the Supreme Administrative Court of last instance adjudicate and do not always have the same position on the issues being resolved\u201d, he explained. “We need such forums so that when formulating decisions we know what practice brings. We are aware of how important our decisions are from the point of view of public administration,” added Supreme Court judge Andrea Morav\u010d\u00edkov\u00e1.<\/p>\n

The symposium opened with several topics and problems of application practice. The speakers also relied on specific decisions on the aforementioned legal issues.<\/p>\n

In the first block, Supreme Administrative Court Judge Mari\u00e1n Fe\u010d\u00edk and Supreme Court Judge Ivana Nem\u010dekov\u00e1, dedicated to the concurrence of actions for the determination of ownership rights and excision actions in insolvency proceedings and the intertwining of the real estate cadastre, bankruptcy and restructuring, underlined the topicality of the topic at a time when many companies are currently going bankrupt and the interest of the courts should also be the interest of creditors.<\/p>\n

The second block concerned the legal status of claims under public law in insolvency proceedings, with an emphasis on claims of the social insurance company, health insurance companies and tax authorities. Judge of the Supreme Administrative Court Michal Novotn\u00fd and Judge of the Supreme Court Andrea Morav\u010d\u00edkov\u00e1 pointed out the decisions of the Supreme and Supreme Administrative Courts in which the panels differ, but also those in which they complement each other in argumentation.<\/p>\n

Among the almost fifty guests were, in addition to judges of the supreme courts, regional and administrative courts, representatives of law faculties, the General Prosecutor’s Office of the Slovak Republic, the Association of Bankruptcy Administrators of the Slovak Republic, the Financial Directorate of the Slovak Republic, and the Office of Geodesy, Cartography and Cadastre of the Slovak Republic.<\/p>\n","protected":false},"excerpt":{"rendered":"
