{"id":72283,"date":"2025-12-02T10:13:12","date_gmt":"2025-12-02T09:13:12","guid":{"rendered":"https:\/\/www.nssud.sk\/?p=72283"},"modified":"2026-04-22T13:03:08","modified_gmt":"2026-04-22T11:03:08","slug":"the-supreme-administrative-court-of-the-slovak-republic-acquitted-judge-judr-michal-kubis-from-the-motion-to-initiate-disciplinary-proceedings-for-serious-disciplinary-misconduct","status":"publish","type":"post","link":"https:\/\/www.nssud.sk\/en\/the-supreme-administrative-court-of-the-slovak-republic-acquitted-judge-judr-michal-kubis-from-the-motion-to-initiate-disciplinary-proceedings-for-serious-disciplinary-misconduct\/","title":{"rendered":"The Supreme Administrative Court of the Slovak Republic acquitted judge JUDr. Michal Kubi\u0161 from the motion to initiate disciplinary proceedings for serious disciplinary misconduct"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>On November 28, 2025, the Disciplinary Panel of the Supreme Administrative Court, by its decision in Case No. 32D\/3\/2025, acquitted the judge of the Municipal Court Bratislava IV, JUDr. Michal Kubi\u0161, pursuant to Section 34, paragraph 2, letter b) of Act No. 432\/2021 on the Disciplinary Rules of the Supreme Administrative Court of the Slovak Republic and on amendments and supplements to certain laws, from the proposal of the Minister of Justice of the Slovak Republic to initiate disciplinary proceedings for a serious disciplinary offense.<\/strong><\/p>\n<p style=\"text-align: justify;\">The judge allegedly committed this act by failing to inform the President of the Bratislava IV Municipal Court or the parties to the proceedings, as a judge in the court proceedings conducted at the Bratislava IV Municipal Court under case file no. 16Cpr\/2\/2023, of the facts that could have formed the grounds for his bias towards the plaintiff&#8217;s legal representative.<\/p>\n<p style=\"text-align: justify;\">According to the Disciplinary Panel of the Supreme Administrative Court, the act committed by the disciplinary accused does not constitute a disciplinary offense.<\/p>\n<p style=\"text-align: justify;\">No appeal is admissible against the decision. The decision of the Disciplinary Panel was adopted by a vote of 5:0.<\/p>\n<p style=\"text-align: justify;\">This was decided by Panel No. 32D of the Supreme Administrative Court, composed of: President of the Panel JUDr. Michal Matuln\u00edk, PhD., the Judges Mgr. Krist\u00edna Babiakov\u00e1, Mgr.
