The Disciplinary Panel finds a judge of the Bratislava IV Municipal Court guilty
In the present proceedings, the Disciplinary Panel decided on the appeal of the disciplinary accused judge against the disciplinary decision of the former disciplinary panel from 2019. In the present proceedings, the Disciplinary Panel was hearing an appeal by a disciplined judge against a disciplinary decision of the former Disciplinary Panel of 2019. The subject of the review was a first instance decision imposing a disciplinary measure in the form of removal from judicial office. In the course of its brief reasoning, the court pointed out that during the appeal proceedings – before the case reached the Supreme Administrative Court of the Slovak Republic – the earlier disciplinary measures issued against the disciplinary defendant had been obliterated. The Disciplinary Panel thus concluded that that fact had to be taken into account in the appeal proceedings.
The decision of the Disciplinary Panel was adopted unanimously and is final. Detailed reasons for the decision will be given in the written version of the decision.
In the disciplinary case of the Minister of Justice of the Slovak Republic c/a Judge JUDr. Marián Kurinec, the decision of the Panel No. 33 of the Supreme Administrative Court of the Slovak Republic was made by the President of the Panel, prof. JUDr. Peter Potásch, PhD (Judge-rapporteur); Judges JUDr. Viola Takáčová, PhD. and Mgr. Kristína Babiaková, PhD; lay judges JUDr. Michaela Kajabová and Mgr. Eva Kováčechová.
