The judge of the Special Criminal Court found guilty
During the public pronouncement of the decision on Wednesday, the President of the Panel stated that, according to the Panel, the disciplinary defendant, as a Pre-Trial Judge, had violated his duty to disclose his bias, i.e., he had culpably violated the duties of a judge to refrain from anything that might undermine the dignity and respectability of the judicial office and also undermine confidence in the independent, impartial and fair administration of justice. He added that the disciplinary defendant erred when deciding on the motion of the prosecutor of the Office of the Special Prosecutor of 4 July 2020 to take into custody the accused Ing. P. K. and Ing. N. B. did not declare his bias.
The decision of the Disciplinary panel was adopted by a 3:2 majority and is not open to appeal.
In the disciplinary case of the President of the Judicial Council of the Slovak Republic and the President of the Special Criminal Court c/a Judge JUDr. Michal Truban, the decision was taken by the Panel No. 32 of the Supreme Administrative Court of the Slovak Republic, composed of: the President of the Panel JUDr. Michal Matulník, PhD. (Judge-rapporteur), the Judges JUDr. Anita Filová, JUDr. Marián Fečík and lay judges JUDr. Zdenka Benčíková and JUDr. Zuzana Čížová.
