The Supreme Administrative Court of the Slovak Republic found prosecutor JUDr. Daniel Lipšic LL.M. guilty in the matter of a problematic conversation with a colleague, and acquitted him of a motion to initiate disciplinary proceedings in two other cases
On January 22, 2026, the Disciplinary Panel of the Supreme Administrative Court, by its decision in case file no. 32D/12/2024, found the prosecutor of the General Prosecutor’s Office of the Slovak Republic, Daniel Lipšic, guilty of one act of the disciplinary motion, and acquitted him of the motion to initiate disciplinary proceedings in the remaining two acts.
The Disciplinary Panel of the Supreme Administrative Court found the prosecutor who was subject to disciplinary motion guilty of inappropriately criticizing his colleague for the circumstances of the delivery of correspondence and of his verbal expression being inadmissible, thereby disrespecting her position as the Director of the Personal Office of the Prosecutor General’s Office. According to the Disciplinary Panel, the prosecutor who was subject to disciplinary motion acted in violation of the basic duties of a prosecutor, namely to maintain dignity in the performance of the prosecutor’s office, to protect the dignity of the office performed and to refrain from anything that could cause harm to the prosecutor’s honor or weaken confidence in his impartiality and to comply with the rules of prosecutorial ethics in the performance of his office. He thus committed a disciplinary offense, for which the Disciplinary Panel imposed a disciplinary measure on him – a written reprimand.
The Disciplinary Panel acquitted the accused prosecutor from the disciplinary motion in part of the fact that, deciding as a superior prosecutor without knowledge of the confidential annex to the investigation file, he should have initiated criminal prosecution and at the same time brought charges because it was not proven that the act for which the prosecutor subjected to disciplinary motion occurred.
The prosecutor subject to disciplinary motion was also acquitted from the motion that in written communication with the management of the Prosecutor General’s Office he stated an inappropriate sarcastic text, thereby improperly disparaging the conduct of the Prosecutor General of the Slovak Republic, because according to the Disciplinary Panel, the act committed by the accused prosecutor does not constitute a disciplinary offense.
No appeal is admissible against the decision. The decision of the Disciplinary Panel was adopted unanimously.
