The Disciplinary Panel imposes a disciplinary measure on a judge of the Special Criminal Court
The Disciplinary Panel of the Supreme Administrative Court of the Slovak Republic recognized Judge Mgr. Pamela Záleská guilty that in the criminal case of the Special Criminal Court on the retrial (Case No. 3 Nt 1/2022), conducted in the panel presided over by her, the members of the panel decided on 23. January 2023, when at a public session the President of the Panel announced the rulling case, but did not make a decision within thirty working days of its announcement (provision of Article 172(3) of the Code of Criminal Procedure with reference to Article 180 of the Code of Criminal Procedure), nor did she request the President of the Court to extend this period by a further 30 working days. It did not submit a written decision, including reasons, to the Registry until 30 May 2023.
“The Disciplinary Panel considered it established that the disciplinary accused had indeed fulfilled the obligation in question, i.e. had drawn up the decision and had ensured its dispatch, but had done so only after the expiry of the time-limit set by law for this purpose. In the context of the subjective aspect of the offence, the Disciplinary Panel considers that the act was committed by the disciplinary defendant judge due to negligence, as no deliberate action of the disciplinary defendant was proven during the proceedings,” said Viola Takáčová, the president of the panel, during the public announcement of the decision.
The decision of the Disciplinary Panel was adopted by a vote of 5:0 and is not open to appeal.
In the disciplinary case of the President of the Special Criminal Court c/a Judge Mgr. Pamela Záleská, the decision was taken by Panel No. 33 of the Supreme Administrative Court of the Slovak Republic, composed of: the President of the Panel, JUDr. Viola Takáčová, PhD.
