The disciplinary appellate panel dismissed the appeal of the President of the Zvolen District Court

The subject of the public hearing of the disciplinary appellate panel of the Supreme Administrative Court of the Slovak Republic on 12 September 2024 was the appeal of the President of the Zvolen District Court against the decision of the Disciplinary Panel of the Supreme Administrative Court of the Slovak Republic, Case No. 31 D 11/2023 of 14 November 2023. 

By its first instance decision, the Disciplinary Panel found Judge Dalibor Miľan guilty of committing a continuing serious disciplinary offence, which he had committed by breaching the obligation to perform his duties conscientiously and the obligation to fulfil his duties properly and in a timely manner, including in the case of authorisation to work in a domestic environment. The harmfulness of the judge’s conduct was particularly heightened by the fact that he had already committed serious disciplinary offences of which he had been found guilty by a previous decision of the Supreme Administrative Court of the Slovak Republic (Case No. 31 D 7/2022 and 41 Do 2/2023). For the above-mentioned disciplinary offence, a disciplinary measure was imposed on Judge Dalibor Miľan in the form of a 50 % reduction in his salary for a period of three months.

The President of the Zvolen District Court filed an appeal against the first-instance decision, in which she continued to demand the most serious disciplinary measure, namely the removal of the disciplinary defendant from his position as a judge.

The Disciplinary appellate panel upheld the first-instance decision of the Disciplinary Panel and dismissed the plaintiff’s appeal (Case No. 42 Do 1/2024).

In the disciplinary case of the President of the Zvolen District Court c/a Judge Mgr.
