The Disciplinary panel finds a judge of the Bratislava I Municipal Court guilty
According to the members of the Panel, the disciplinary defendant, JUDr. Roland Kemény, did not act conscientiously in the criminal case assigned to him and did not act without unnecessary delays, thus causing the statute of limitations to run on the criminal prosecution. For that, the Disciplinary panel imposed on him a cumulative disciplinary measure in the form of a 30% reduction in his salary for a period of three months, having taken into account another disciplinary measure imposed on him. The disciplinary complaint against Judge Roland Kemény was lodged by the Minister of Justice of the Slovak Republic (Case No. 33D/7/2023).
During the pronouncement of the decision, the President of the Panel stated that the disciplinary accused judge, by his culpable conduct, had violated the obligation according to which a judge is obliged to perform his duties conscientiously, to act smoothly and without unnecessary delay in the cases assigned to him. “In relation to the act charged against him, the members of the Disciplinary Panel considered that it had been established that the disciplinary defendant had not taken any action in the case for more than three years, which had the significant and undesirable consequence of limiting the prosecution and bringing the proceedings to a halt. As the Supreme Administrative Court of the Slovak Republic has repeatedly stated, one of the basic duties of a judge in criminal proceedings is to control the passage of the statute of limitations,” said Kristína Babiaková, the President of the Panel.
The decision of the Disciplinary panel was adopted by a vote of 5:0 and is final.
In the disciplinary case of the Minister of Justice of the Slovak Republic, c/a JUDr. Roland Kemény, the decision was taken by the Panel no. 33 of the Supreme Administrative Court, composed of: the President of the panel Mgr.
